MSHA Inspector = Judge, Jury, & Executioner!!

James Petrie, District (1) Manager recently (2/4/08) sent out a memo to Inspectors.  This memo (PROCEDURE INSTRUCTION LETTER) notified Inspectors that the ONLY citation/order that will be allowed to get a conference are High Negligence and Unwarrantable Failures. 

This means that whatever citation/order the friendly MSHA Inspector gives you at the end of your inspection means that YOU ARE STUCK with it!!!

What can you do about this?  Hire us to perform a mock inspection!  Our mock inspection will point out areas that most likely will earn you a citation.  Remember that your 104(a) citations are not conference-able, and go towards your citation history, which MSHA will use against you to INCREASE you fines on the next inspection!

MSAH, LLC is offering a JJE Special (Judge, Jury, Executioner) special of ONE Mock Inspection for $700.00.  This will consist of one eight hour inspection, and no report.  Basically, you or your supervisor will walk along with one of our Associates, and the Associate will point out potential problem areas, and give you advice on what to do to prevent a Citation!

New Changes to Civil Penalty Payment Process

MSHA is implementing several new changes to improve its civil penalty payment process. These changes are intended to streamline the debt collection process and make it more user friendly for everyone.

New Mailing Address- Beginning October 1, all payments for civil penalties must be mailed to a new address: U.S. Department of Labor/MSHA, P.O. Box 790390, St. Louis, MO 63179-0390.

Electronic Funds Transfer- Payments made by check will be converted into electronic funds transfers and electronically debited to a company's account. Debits will usually occur within 24 hours and will appear on regular account statements

Assessment Statement Delivery- MSHA will deliver monthly Assessment Billing Statements via Federal Express. Federal Express delivery requires a street address and not P.O. Box or Drawer.

Beginning September 17, 2007, MSHA will deliver your monthly Assessment Billing Statement via Federal Express (FedEx). FedEx delivery requires a street address (not a PO Box or Drawer). As a result, we will be using the street address from the most recent Legal Identity Report (MSHA form 2000-7).

MSHA asks that companies ensure that the Address of Record reported on the Legal Identity Report is correct. If another address is desired, please update the Mine's Legal Identity Report. This can be done by filing a paper copy that can be obtained from the mine's servicing district office, or online by accessing the Agency's website, Mine Safety and Health Administration (MSHA) - U.S. Department of Labor - Forms and Online Filings (www.msha.gov under the Forms/Online section of Quick Links).

Independent contractors must also ensure that their records with MSHA are up to date and contain a street address. Contractors should provide MSHA with the following information: Contractor ID, Contractor Name, Street Address, City, State and ZIP Code, and Phone Number.

New Civil Penalty Provisions- Significant changes were made to 30 CFR Part 100, Criteria and Procedures for Proposed Assessment of Civil Penalties. The changes became effective on April 23, 2007. The significant changes made to this rule are explained may be viewed using this link.

MSHA announces new process for collecting civil penalties:

ARLINGTON, Va. - The U.S. Department of Labor's Mine Safety and Health Administration (MSHA) is implementing several new changes to improve its civil penalty payment process, the agency announced today.

"These are the first of several changes that we are making to streamline our debt collection process," said Jay Mattos, acting director for MSHA's Office of Assessments. "Our goal is to establish a better process that is more user friendly for everyone."

New Mailing Address - Beginning October 1, all payments for civil penalties must be mailed to a new address: U.S. Department of Labor/MSHA, P.O. Box 790390, St. Louis, MO 63179-0390.
